What is sick leave

Sick leave (certificate of incapacity for work) is a document that gives the right to temporarily not go to work and receive monetary compensation for the forced downtime. The certificate of incapacity for work is a unified document. The sick leave form was approved in 2011 by a special order of the Ministry of Health and Social Development of the Russian Federation (No. 347n).

The sick leave is filled out on a computer or by hand. Mandatory in Russian in printed capital letters. You can write with black gel, capillary or fountain pen (use of ballpoint is not allowed).

The diagnosis is not written in sick leave. Instead, indicate a code corresponding to the basis for issuing sick leave. For example: 01 - disease, 02 - injury, 03 - quarantine, and so on.

How sickness benefits are calculated

Payment of benefits for temporary disability is guaranteed by the Labor Code of the Russian Federation and the Federal Law "On compulsory social insurance in case of temporary disability and in connection with motherhood."

To receive benefits, a closed sick leave must be handed over to the accounting department. The employee has six months for this, but it is better not to delay.

Personnel officers will fill out the second part of the form and will accrue temporary disability benefits (it will come to you with the next advance payment or salary). How many? Let's count.

The amount of sick leave benefits depends on your earnings and length of service. The calculation formula is as follows:

Hospital allowance = average daily earnings × number of sick days × percentage based on length of service.

Thus, three variables are needed.

To calculate your average daily earnings, you need to divide your earnings for the last two calendar years by 730 days. At the same time, the law provides for a limit on income taken into account for paying sick leave. In 2016, this amount was 718,000 rubles, in 2017 - 755,000.

When calculating hospital benefits in 2017, the average daily earnings cannot exceed 1901.37 rubles. The minimum daily wage is set based on the minimum wage.

Insurance experience is the time during which you work officially, and the employer makes contributions to the Social Insurance Fund. If the work experience is more than 8 years, the allowance is paid in the amount of 100% of the daily earnings. If the experience is from 5 to 8 years, in the amount of 80%. With less than 5 years of experience, you will receive only 60% of the average daily earnings.

The number of days of illness is determined by the certificate of incapacity for work. In this case, vacation is thrown away at its own expense.

An example of calculating sick leave

To make it clearer, let's look at an example. Let's say Ivan Ivanovich Ivanovich has an insurance record of 6 years. By the way, it is not necessary for the last two years to work for the very employer who has issued sick leave. The main thing is to provide a 2NDFL certificate from the previous place of work.

In 2015 and 2016, Ivan Ivanovich earned 600,000 rubles each. In two years - 1,200,000.

On December 16, 2016, he fell ill, went to bed with a temperature. I called the therapist of the mobile clinic DOC + to the house and was treated for 11 days. In his sick leave, he has numbers from 2016-16-12 to 2016-26-12.

Let's calculate the average daily earnings of Ivan Ivanovich: 1,200,000 / 730 = 1,643.84 rubles.

The number of paid sick days is 11. Since the work experience is less than 8 years, sick leave will be paid at the rate of 80%. Now let's substitute the resulting values into the formula.

Ivan Ivanovich's hospital allowance = 1,643, 84 rubles × 80% × 11 days = 14,465, 79 rubles.

Income tax will be withheld from this amount.

Please note: having fallen ill during paid leave, you have the right to extend it by the number of days of temporary disability.
