Is it possible to get a loan using a copy of a passport

“A million dollar loan was hung on a pensioner”, “Collectors are being persecuted because of someone else's loan” - such headlines are often found on Internet forums and even in the media.

It is not surprising that in the mass consciousness there is a stereotype that anyone can apply for a loan for anyone. There would only be a copy of the passport, or at least a series and number. Let's see if this is really so.

The documents

Any credit and microfinance organization has a list of documents required for a loan (loan). Some have strict rules and the list is long: a passport with a registration mark, 2-NDFL, SNILS, TIN, marriage certificate. Others do not even require a certificate from their place of work, they only need a passport. But definitely the original!

Obtaining a loan or a loan on a copy of a passport contradicts the provisions of the Federal Law "On Counteracting Legalization (Laundering) of Incomes …". According to him, the bearer of a copy of the passport is considered unidentified. None of the lenders working within the legal field, be it a bank or a microfinance company, will accept a copy of the passport without reconciling it with the original.

Fraud schemes

However, occasionally unpleasant incidents do happen.

  • Collusion with bank employees. To turn a scam, fraudsters need to at least agree with a loan officer who prepares the documents. You may also have to share with the cashier, who issues cash according to the passport, and the security service, which checks the borrower. Example: a bank employee, using passport data, issued a loan for a friend of her lover, whom she had never seen.
  • Abuse of authority. Sometimes bank employees consider themselves smarter than the credit system and spend slightly larger amounts than the borrower asked for. They put the difference in their pocket. Example: a person came for a car loan, and an employee also issued a microloan for him.

In all these cases, the human factor plays a key role.

Without the assistance of an unscrupulous employee of a credit or microfinance organization, it is impossible to issue a loan using a copy of a passport.

And finding such an employee is not easy. After all, such actions threaten not only with the loss of work, but also with criminal prosecution.

According to Anastasia Loktionova, if a citizen attempts to obtain a loan or loan using a copy of his passport, it will be qualified as fraud under Article 159.1 of the Criminal Code of the Russian Federation.

Precautionary measures

To be sure to protect yourself from fraud:

  • Do not post your passport data on social networks (including in "Documents" in "VKontakte") and do not send them by e-mail (or delete them immediately after receiving by the addressee).
  • Do not store copies of documents in the clouds or on flash drives. If you have uploaded a scan of your passport to Google Drive, follow the access settings when sharing any files.
  • If you lose your passport, contact not only the passport office, but also the police.
  • Check your credit history regularly.

If you receive a payment on a loan or loan that you did not take, do not panic. Take your passport in hand and go to clarify the situation with a credit or microfinance organization. Draw up an explanatory note, talk to the employee who approved the loan, request recordings from CCTV cameras on the day of its registration. Remember, the law is on your side.

If a bank or microfinance organization violates the law "On consumer credit (loan)" or "On the protection of the rights and legitimate interests of individuals when carrying out activities to recover overdue debts …", you can complain about them to Roskomnadzor or the prosecutor's office. If the law is violated by the collectors, you should write a complaint to the Federal Bailiff Service. At the same time, it is important to prove the fact that the organization has exceeded its powers.
