How to restore lost labor and what are the obligations of the employer?
Sergey
If you have lost your work book, do not be discouraged. Better remember that the whole of 2020 was dedicated to the transition to the so-called electronic labor. From January 1, 2020, all information about the employee's labor activity is transferred. From January 1, 2020, the federal law on the electronic work book comes into force in Russia directly to the Pension Fund of the Russian Federation.
Therefore, just go to the official website of the Pension Fund and in your personal account order an extract from STD-PFR (Information on employment). It is formed in literally a minute, and in it you will see all the information about your work activity starting from 2020.
And more recently, from December 2020, this statement began to display information until January 1, 2020. But only in the form of the name of the employer and the periods of work. You will not find job titles, transfers and reasons for dismissal. This information can be added to the Federal Law of February 24, 2021 No. 30-FZ from March 7, 2021, by independently applying to the Pension Fund with your paper work book.
Next, contact your last employer with an application for a duplicate work record book. He must Decree of the Government of the Russian Federation of 2003-16-04 N 225 (ed. Of 2013-25-03) "On work books" to do this no later than 15 days from the day the employee submits the application.
In the duplicate, the employer can indicate only the information that was provided by the employee. Ideally, certificates from previous employers are needed, but the STD-PFR extract, which we received on the Pension Fund website, is also suitable for the Labor Code of the Russian Federation Article 66.1. Information about labor activity.
In addition, in the duplicate, the employer must indicate your total work experience in total. For example: "The total work experience is 5 years, 4 months, 23 days." Such a record is made only if you had previous jobs.
Sometimes the employer can also lose the work book. But in this case, the employee will have to deal with the restoration. And the order of actions does not change much.
However, the employer is obliged to the Resolution of the Ministry of Labor of Russia dated 10.10.2003 N 69 (as amended on 31.10.2016) "On approval of the Instruction for filling out work books" to assist in obtaining these documents. As a rule, he simply gives the employee a cover letter in which he asks previous employers to provide a certificate of the period of work, indicating all orders for hiring, transfers and dismissals.
But if the employer refuses to assist in this way, then the law does not provide for methods of influencing him. Therefore, always try to keep documents from previous jobs. Then it will be much easier to restore the record and experience.
