Why are cars equipped with the sign "Disabled"?

According to the traffic rules, there are two signs designed to notify road users that a person with disabilities is driving or just in a car:

  1. "Disabled" is a yellow square with a side of 15 cm and a wheelchair figure inside.
  2. “Deaf driver” is a yellow circle 16 cm in diameter, inside which three black dots form a triangle.

The installation of these signs is voluntary. But they can be used by strictly defined categories of citizens.

Who can stick the sign "Disabled" on the glass of the car?

Disabled persons of I and II groups and persons transporting them, as well as parents of disabled children have the right to do so.

The driver of a car with the sign "Disabled", in addition to his rights, vehicle registration certificate and insurance, must have with him "a document confirming the fact of the establishment of disability" (Decree of the Government of Russia dated January 21, 2016).

What specific document is not established by law. But it must indicate the group and the reason for the disability. Such documents are a pension certificate and a certificate of passing a medical and social examination (the so-called pink form).

When stopping by a traffic police inspector, a disabled driver or a driver transporting a disabled person must present the original of one of these documents. Copies, even notarized copies, are not accepted.

What privileges does the "Disabled" sign give on a car?

A number of prohibition signs (section 3 of Appendix 1 of the SDA) do not apply to cars with "Disabled" signs installed on their front and rear windows:

  • "Movement Prohibition";
  • "The movement of motor vehicles is prohibited";
  • "No parking";
  • "Parking is prohibited on odd days of the month";
  • "Parking is prohibited on even days of the month."

But most importantly, the sign "Disabled" gives the right to use specialized parking spaces.

What is disabled parking?

In parking lots near socially significant objects, at least 10% of the places must be allocated for parking for people with disabilities (Article 15 of the Federal Law "On Social Protection of Disabled People in the Russian Federation"). That is, there should be at least one specialized parking space near any clinic, house of culture or shopping center.

Only cars with the "Disabled" badge are eligible to get into these seats.

Why are disabled parking lots always occupied by non-disabled people?

There are two reasons:

  1. The most convenient parking spaces are allocated for drivers and passengers with disabilities.
  2. Disabled parking is free.

Previously, parking spaces for disabled people were occupied by all and sundry. A fine of 200 rubles did not frighten anyone. In 2016, the legislation was tightened, and unscrupulous motorists began to carry a yellow sign with a wheelchair in the glove compartment, just in case. (It is sold absolutely free and costs mere pennies.) It is unlikely that the inspector will wait several hours for the driver to check the documents.

But the bigger the city and the more acute the parking problem, the more resourceful the car enthusiasts are. In Moscow, cars with the sign "Invalid" are entered into a separate register, and their owners are issued special parking permits. They give the right to stand as long as you need, even in paid parking lots. For this, car owners buy fake disability certificates.

What is the threat to those who illegally use the sign "Disabled" and parking for people with disabilities?

Violators face fines. The Code of Administrative Offenses of the Russian Federation has three articles about this:

  1. Article 12.4 on illegal installation of the sign "Disabled". The fine is 5,000 rubles for individuals, 20,000 rubles for officials and 500,000 rubles for legal entities. Plus the removal of the plate itself.
  2. Article 12.5 on driving a vehicle on which the sign "Disabled" is illegally installed. The fine for the driver is 5,000 rubles. Plus sign confiscation.
  3. Part 2 of Article 12.19 on violation of the rules for stopping and parking vehicles in places for disabled people. The fine is 5,000 rubles.

    Are people with disabilities on the road protected?

    Despite heavy fines, people with disabilities are constantly faced with the rudeness of healthy motorists, and due to imperfect legislation they find themselves in various unpleasant situations.

    If a person with a disability drives a car himself, there are almost no problems. Well, if you do not take into account the impudent people who occupy places for disabled people in the parking lot, and the fact that electronic machines in parking lots do not yet accept disability documents.

    But if the disabled person is carried by relatives or friends, puzzles begin. What to do, for example, if a person brought a disabled person to the hospital, stayed in the car to wait for him and suddenly the traffic police inspectors arrived? The driver must show them the rights and the disabled person with a certificate of disability. And in the original. If there are none, it turns out that he illegally hung up the sign "Disabled" and could be fined.

    The opposite situation: the wheelchair user asked a friend to give him a lift to the shopping center. The friend does not have the “Disabled” identification mark, which means that they will have to look long and hard at the store for where to park, even if the specialized places are empty. They cannot get up there, even though he is disabled and here is his certificate.

    Also, our yellow plate is not always perceived by CCTV cameras. Having passed under the "privileged" prohibiting sign, it is quite possible to get a "letter of happiness".
