What counts as noise

It would seem that everything is simple: if sound disturbs someone, this is noise. But "loudly" is a relative concept. Someone doesn't even care about the party. And someone is ready to walk and complain that neighbors flush the toilet too loudly at night. This is not a reason to endure until the morning - it is better to find out what the law says about this.

The maximum permissible noise level is defined in SanPiN. Moreover, restrictions exist not only for the night. The legal loudness limit is 45 decibels at night and 55 decibels during the day. To make it clearer, here are some examples:

  • rustle of foliage - 15 decibels;
  • the ticking of a wristwatch or a whisper - 20 decibels;
  • muffled conversation - 30 decibels;
  • normal conversation - 40 decibels;
  • noise at the workplace in production or loud conversations, electric shaver - 65–70 decibels;
  • vacuum cleaner, hair dryer - 40–80 decibels;
  • puncher, squeal - 100-120 decibels;
  • aircraft engine - 140 decibels.

There are standards for noise in the local area: 70 decibels during the day and 60 - at night.

When you can't make noise

SanPiN defines the night time from 11 pm to 7 am, and it is precisely this time that many consider the period when one should not make noise. But this is not the case everywhere. According to the leading lawyer of the European Legal Service Maxim Bekanov, each subject has adopted one or another law that regulates when you need to be quieter. Sometimes this period coincides with that specified in SanPiN. And sometimes the local authorities change it. For comparison:

  • In Moscow, you can't make noise from 23 to 7 o'clock. At the same time, loud repair work is prohibited from 19 to 9 o'clock and from 13 to 15 o'clock, as well as on Sundays and non-working holidays.
  • In St. Petersburg, the night time is from 22 to 8 hours.
  • In the Saratov region, you cannot make noise from 21 to 9 o'clock.
  • In the Ulyanovsk region, it is forbidden to be unnecessarily loud from 11 pm to 7 am on weekdays and until 9 am on weekends and holidays, as well as from 1 pm to 3 pm daily.

To know exactly when to make noise, it is better to look for a regulatory act in your region. The necessary provisions can be enshrined in the law on administrative offenses or displayed in a separate document.

How to tell if you're being too loud

You hardly ever carry a sound level meter with you so as not to disturb anyone. Usually this is not expected of you. Therefore, the regional law often stipulates what exactly cannot be done. For example, the regulations of Moscow and St. Petersburg at night prohibit:

  • Use televisions, radios, tape recorders and other sound-reproducing devices.
  • Play musical instruments, shout, whistle, sing and make loud noises.
  • Move furniture.
  • Launch pyrotechnics (except for New Year's Eve).
  • Make repairs, carry out loading and unloading operations.

This also applies to the local area next to residential buildings, hospitals, sanatoriums and other buildings in which people need peace. So you shouldn't turn on a portable speaker under someone else's windows.

However, you are unlikely to have any questions if you loudly eliminate the consequences of accidents or perform other urgent work at night. Religious practices are often an exception. The local law will tell you more precisely.

Than excessive volume threatens you

You will be fined. To what extent is established by regional laws. To bring you to justice, the disaffected must call the police. They will record the noise and write out a protocol. This is how it works in theory. In practice, it is not easy to prove a violation. Most likely, the district police officer will simply conduct a preventive conversation with you.

But this is not an indulgence to noise at night. First of all, you can still be fined. Secondly, it is not possible punishment that should stop you, but common sense. Sleep is a basic human need that greatly affects the quality of his life. And noise, especially impact noise, interferes with normal rest.

So moving furniture, hammering nails and throwing a ball to the dog at night is not worth it. To check the volume of the music, just go to another room. If you don't hear anything, neither do the neighbors. And for such cases, headphones have been created.
