What is registration and how is it called correctly

In modern Russian legislation there is no concept of "registration", although it continues to be used out of habit. It was replaced by two forms of registration of citizens of the Russian Federation.

At the place of residence

We are talking about an apartment, a house, a room where you live permanently (at least officially). The Russian is obliged to the Law of the Russian Federation of June 25, 1993 N 5242-1 to have registration at the place of residence. An exception is made by the Law of the Russian Federation of June 25, 1993 N 5242-1 only for indigenous peoples leading a nomadic lifestyle.

If, for some reason, you have to deregister in one place, in order to register in another, you have the Law of the Russian Federation of June 25, 1993 N 5242-1 seven days. Otherwise, you may be fined by the Code of Administrative Offenses of the Russian Federation Article 19.15.2 by 2-3 thousand rubles, and in Moscow or St. Petersburg - by 3-5 thousand. The owner of the premises where you live without registration can also be punished financially.

When registering, a corresponding stamp is put in the passport in the "Place of residence" section, for which the space from the 5th to the 12th page is allocated. Children under 14 years old are issued a certificate of registration at the place of residence.

At the place of stay

If you have moved to another region for more than 90 days, you need the Law of the Russian Federation of June 25, 1993 N 5242-1 to issue a temporary registration. If this is not done, you may be fined the same amount as in the absence of permanent registration.

There are, however, a few exceptions. You can do without additional body movements if you:

  • are registered (for simplicity, we will use this word when it comes to registration at the place of residence) in the Moscow region, but you live in Moscow - and vice versa;
  • are registered in the Leningrad region, but you live in St. Petersburg - and vice versa;
  • are registered in Sevastopol, but you live in another settlement of the Crimea - and vice versa.

Information about temporary registration is not indicated in the passport in any way, you will be given a separate certificate. At the same time, you will not be removed from permanent registration.

Why do I need to register

The question of whether registration is needed should not be: this is a legal requirement. In addition, some things are much easier to do with it:

  • Apply to the nearest clinic. This is possible without registration, but only with the consent of the head physician.
  • Get a place in kindergarten.
  • Send your child to the nearest school. With registration, he is required to provide a place, without it - only if the classes are not filled.
  • Find a job - some employers require registration.
  • Apply for benefits and benefits.

What documents are needed for registration

To register at the place of residence or stay, you will need the same package of documents, which includes:

  • Passport or birth certificate for children under 14 years old.
  • An application for registration at the place of residence (for permanent and No. 1 for temporary) - is filled out at the place of submission of documents or at the "State Services", more on this later.
  • A document confirming the right to reside at this address. This can be a certificate of ownership of an object, if it was acquired before 2016, an extract from the Unified State Register of Real Estate, a certificate of the right to inheritance, a social employment contract, a court decision on recognizing the right to use a residential premises, and so on. Keep in mind: if the information contained in the document is at the disposal of state and municipal authorities, then you can not bring anything to the Government of the Russian Federation of July 17, 1995 N 713 - the department must request it yourself. In practice, having papers makes it very easy to understand.
  • Departure sheet, if you have checked out in advance.

If the home is privately owned, and you are not one of its owners, then the consent of all the owners will be required. They must come with you to submit documents and write an appropriate application. Alternatively, you can bring their notarized consent with you. An exception is made for children who have one of the parents registered in the apartment. If the dwelling is in state or municipal ownership, it is possible to register in it a person who is not specified in the lease agreement, only if he is the child of the tenant or a member of his family. The rest will have to sign a sublease agreement.

How to apply for registration

And start filling out the application. For registration at the place of residence and stay, they are almost the same. You will need to specify:

  • Personal and passport data.
  • Do you have a permanent registration and at what address.
  • At what address do you intend to register.
  • Have you deregistered at your previous place of residence?
  • Is registration carried out for your living space and, if not, who owns the object.
  • Do you have citizenship of another country.
  • Why do you move, what do you work, do you use social security.
  • Does any of your close relatives live at the address where you want to register.

Select the department of the Ministry of Internal Affairs where you would like to submit documents. After that, it remains to confirm consent to the processing of personal data and awareness of responsibility for providing false information and false documents.

Within three days after sending you will receive a message with a call to the department of the Ministry of Internal Affairs, where you need to appear with a package of documents. Most likely, you will receive a stamp in your passport or registration certificate on the day of your visit.

2. Through the multifunctional center

You can contact the nearest MFC with a package of documents (and the owner of the premises, if it is not you). It is better to make an appointment in advance by phone so as not to stand in line.

You will have to come to the MFC twice: to submit documents and to receive.

3. Through the passport office of the management company

Some UK provide such services - find out in yours. The algorithm of actions is the same as in the MFC.

4. Through the Directorate for Migration (Migration Office)

You can directly contact the department of the Ministry of Internal Affairs. Here again, two visits are required. If you can make an appointment by phone, it is better to do so, otherwise you risk standing in line for a long time.

How long will it take to register

The Department for Migration Issues has the Law of the Russian Federation of June 25, 1993 N 5242-1 three days from the date of submission of documents to resolve the issue. Moreover, sending papers in electronic form is also considered. If you contact the MFC, take into account the time during which the documents will travel to the UVM and back.

How to deregister

Depends on why you need it. If you are just going to register for your place of residence elsewhere, then you can do nothing. The corresponding mark in the passport will be put in the department for migration issues of the Ministry of Internal Affairs, to which you apply for registration. For this, there is exactly point 6 in the statement.

Documents with new data must be sent by the Decree of the Government of the Russian Federation of 07.17.1995 N 713 to the UVM at your previous address within three days. However, this requirement is not always met, and it happens that for different departments you are registered at different addresses. Therefore, it is better to monitor the situation. For example, the fact that you are still listed at the old address may be evidenced by the number of people in the payment for housing and communal services. If time has passed and nothing has changed, file a complaint through the same "State Services". Usually the problem is solved very quickly.

It is impossible to write out a minor to anywhere - only with simultaneous registration at a new place of residence. If the house belongs to him in whole or in part, then the permission of the guardianship authorities will be required, which will make sure that his rights are not infringed.

Temporary registration will end automatically when it expires. This works for both adults and children.

The government wants to know why you need it. If one of the reasons indicated in the screenshot is about you, do not forget to take the justifying document with you to the UVM. If none of them fit, select the last line "Other". You will have to write an explanation there. For example, a move could be the reason.

On the day of submission of documents, the employees of the UVM will put a mark in the passport on deregistration at the place of residence and issue a departure sheet. The document will be needed when you register at the place of residence.

What to remember

  • It is not necessary to sign out separately, it is done automatically. If you are refused and sent to check out first, it is against the law.
  • It is easiest and fastest to register at the place of residence or stay through the "State Services".
  • Documents, in addition to those specified in the law, Decree of the Government of the Russian Federation of July 17, 1995 N 713 of an identity card, an application and a paper confirming the right of residence (and then only in the case when state bodies do not have access to this information) should not be required from you.
