When can a quality product be exchanged?

You can exchange a good quality product (that is, even if it is defective) within 14 days, if it did not suit you Law of the Russian Federation of 1992-07-02 N 2300-1 (as amended on 2016-03-07) "On the protection of consumer rights.":

  • in shape,
  • in size,
  • by style,
  • by color,
  • to size,
  • on a complete set.

Let's say you bought a lamp for your bedside table. At home, it became obvious that it absolutely does not match the wallpaper, and the shade is not as round as you imagined it, looking at the packaging. What should be the procedure to return or exchange such an item?

  1. We do not hesitate. The return period is not that long, and two weeks can slip by unnoticed. Moreover, the product should not have any traces of exploitation.
  2. We carefully check the purchase: the goods must be clean and serviceable (the presentation and consumer properties are preserved).
  3. We pack the lamp in the original box. Do not forget to include all the bags, instructions, warranty documents and foam inserts there.
  4. We are looking for proof of purchase - cash or sales receipt.
  5. We go to the store where the lamp was bought. The manager or commodity specialist will ask you to draw up an application for the exchange or return of goods.
  6. The seller must provide you with a similar product or (if this is not available) offer a refund of the money paid. They must be returned within three days.

If the store employees do not make contact (refuse to accept the goods, do not acknowledge the purchase in their store), record all your actions in writing. Write to the name of the store management a claim with a request to exchange the purchase, in two copies. One will remain with the seller, the second, with a record of the acceptance of the document from the responsible employee, with you. If the purchase was expensive, you can think about the need for litigation.

Don't worry. You cannot be denied an exchange of goods if the check is not on hand. The fact of purchasing goods from a specific seller is confirmed by:

  • testimony of witnesses (if you were shopping with friends, take them with you);
  • a warranty card or product documentation, where any marks are made to confirm payment;
  • the originally issued invoice;
  • transactions on a bank account, if you paid for the purchase with a card.

What are the exceptions

Alas, some goods cannot be returned. Even if they did not suit you in color or size. The list of such things is legally enshrined.:

  • goods for the prevention and treatment of diseases at home (syringes and tubes, bandages and gauze napkins, lenses and glasses, childcare items);
  • personal hygiene items (toothbrushes, combs, hair curlers and hairpins);
  • Perfumes and cosmetics;
  • goods sold per meter (fabric, ribbons and lace, cables and cords, construction and finishing materials);
  • underwear, socks and stockings;
  • items made of polymeric materials in contact with food (dishes, food containers, cutlery);
  • household chemicals, pesticides, agrochemicals;
  • household furniture (headsets and sets);
  • jewelry and other products made of precious stones and metals;
  • vehicles (cars, motorcycles, trailers, watercraft, bicycles);
  • technically sophisticated household goods;
  • civil and service weapons and cartridges for them;
  • animals and plants;
  • printed matter (books, magazines, calendars, etc.).

How to get a refund for a product purchased on the Internet

If you made an order on the Internet, remember that you can cancel it at any time before receiving it or return it within seven days after receiving. Moreover, if you were not notified (in writing) about the procedure and terms of return, then this period is increased. up to three months.

The requirements for the returned goods are the same: the presentation and consumer properties are preserved, there are documents confirming the fact of payment (electronic checks, receipts, card transactions). Upon return, the buyer is only required to pay the shipping costs of the goods to the seller. In any form, an application for the return of goods is drawn up in the name of the director of the online store, indicating the details of the purchase and the buyer's data, with a request to transfer the money for the purchase. The amount must be returned within 10 days from the date of the claim.

Unfortunately, if a quality product has individually defined properties and can only be used by you (for example, a figurine made according to a sketch or a suit tailored to your measurements), you cannot refuse it.
