Step 1. Issue a final warning

Today you will not surprise anyone with a garbage bag at the entrance, even if there is a garbage chute. It's one thing when neighbors put a bag of waste outside the door, because it is rotten, and a little later they intend to carry it. And it's another matter if the garbage appears regularly, but "a little later" never comes. Especially resourceful people throw garbage bags near the elevator, under the flights of stairs, at the entrance to the staircase.

Announcements calling to observe the culture of everyday life, as a rule, are broken about arrogance and indifference. And if the neighbors play pigs in the open, not hiding their faces, then the comments are usually also parried. Here are the typical "arguments" for not cleaning up tenants.

We pay the cleaning lady, so let her clean up

Counter argument: collection and removal of household waste is not included in public services for cleaning entrances (GOST R 51617-2000). Cleaners are not required to take out residents' trash bags.

I put it near my door, I don't bother anyone

Counter argument: according to sanitary standards, garbage must be removed daily. A bag of trash, especially food leftovers, is a bait for cockroaches and rodents.

I have no place at home

Counter argument: bulky can be attributed to construction waste, and its storage in stairwells is strictly prohibited. In this regard, there is a separate Resolution of the Government of the Russian Federation of April 25, 2012 and the Resolution of the State Construction Committee of the Russian Federation of September 27, 2003.

Stock up on counterarguments and issue a final warning to your rude neighbors. If it doesn't help, take action.

Step 2. Take photos and videos

Install a video camera in the entrance to understand which apartment the scavengers live in. If the "heroes" are known, take a photo of the trash they put up a couple of times. It's good if the photo has the date and time. You will need video and photographic materials in the future to bring your neighbors to justice.

Step 3. Install the owner

Entrances and stairwells belong to the common property of the apartment building. Owners must adhere to the Rules established by the Government of the Russian Federation and comply with sanitary and epidemiological legislation.

According to SanPiN 2.1.2.2645-10, during the operation of residential buildings and premises, littering, pollution and flooding of staircases and cells is not allowed.

The owners are responsible for the maintenance of the common property, which means that they need to be held accountable. If the apartment is rented out, both the owner and the tenant specified in the contract will bear responsibility.

The first step is to find out who the sloppy neighbors are: the owners or the tenants. This information is available from the senior in the house, in the management company, HOA or TSN.

Step 4. Complain to Rospotrebnadzor

Control over the sanitary and epidemiological legislation is carried out by Rospotrebnadzor. Calling the district police officer is useless. A law enforcement officer is not entitled to draw up a protocol and initiate administrative proceedings in this case.

The actions of neighbors throwing stinking garbage bags outside the door, leaving them near elevators or on stairs, fall under article 6.4 of the Code of Administrative Offenses. The punishment can be a fine from 500 to 1,000 rubles.

Write a statement on the fact of garbage storage at the entrance to the territorial body of Rospotrebnadzor. This can be done in person, by mail, or through the service's website.

Indicate:

  • in which apartment the violators live;
  • who is the owner of the dwelling;
  • who lives in it;
  • how often neighbors leave their waste at the entrance.

Support your words with photo or video evidence. At the end, ask to conduct a check and bring violators of the sanitary and epidemiological rules to justice. It is good if you connect other neighbors and the appeal will be collective.

Rospotrebnadzor must conduct a check and within 30 days issue a reasoned response.

Step 5. Contact the police (optional)

If Rospotrebnadzor does not find anything illegal in the actions of sloppy neighbors, appeal the decision of the Service in court. And if the neighbors are not afraid of penalties, try to contact the police. Internal affairs officers can initiate a case under Article 8.2 of the Code of Administrative Violations. In this case, administrative responsibility occurs regardless of the presence of any dangerous consequences. The fine is from 1,000 to 2,000 rubles.

I also recommend complaining to the fire department. After all, a garbage bag can ignite from an accidentally thrown cigarette butt, and rubbish in the entrance blocks the escape route.
